END USER LICENSE AGREEMENT

TOUR – On-Demand Taxi Application

Operated by Budastoor Motors W.L.L.

State of Kuwait

Effective Date: 20th May 2026

These Terms & Conditions (“Terms”) govern your access to and use of the TOUR mobile application, website, customer support channels, technology platform, software, and related transportation services (collectively, the “Platform”) operated by Budastoor Motors W.L.L., a company incorporated under the laws of the State of Kuwait and operating under the brand name TOUR (“Budastoor Motors”, “TOUR”, “Company”, “we”, “our”, or “us”).

By accessing, registering, or using the TOUR Platform or Services, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform and Services.

1. DEFINITIONS

For the purposes of these Terms:

  • “Platform” means the TOUR mobile application, website, software, APIs, communication systems, and related technology infrastructure.
  • “Services” means transportation, ride-booking, chauffeur, and related mobility services made available through the Platform.
  • “User”, “Customer”, or “you” refers to any individual accessing or using the Platform.
  • “Driver” means any independent driver, chauffeur, or transportation provider offering services through the Platform.
  • “Account” means the registered user account created on the Platform.

2. NATURE OF SERVICES

TOUR is a technology-enabled mobility platform owned and operated by Budastoor Motors W.L.L. that facilitates transportation-related services within the State of Kuwait.

The Platform enables users to:

  • Request on-demand taxi services
  • Schedule rides in advance
  • Arrange airport transfers
  • Book chauffeur-driven vehicles
  • Access transportation for personal or corporate use

Once a booking is confirmed, the Platform may display:

  • Driver name and profile photograph
  • Vehicle details and plate number
  • Driver contact information
  • Estimated arrival time
  • Estimated fare (where applicable)

Budastoor Motors reserves the right to refuse, cancel, or reschedule bookings based on operational, safety, legal, or regulatory reasons.

3. ELIGIBILITY

To use the Platform and Services, you must:

  • Be at least eighteen (18) years of age;
  • Have the legal capacity to enter into binding agreements under Kuwaiti law;
  • Provide valid and accurate registration information.

Users below the age of 18 may only use the Services under the supervision and responsibility of a parent or legal guardian.

Budastoor Motors reserves the right to suspend or terminate access if eligibility requirements are not met.

4. ACCOUNT REGISTRATION

To access certain Services, you may be required to create a personal Account.

You agree that:

  • All information provided during registration shall be accurate, complete, and current;
  • You are solely responsible for maintaining the confidentiality of your Account credentials;
  • You are fully responsible for all activities conducted under your Account.

You may not:

  • Share your Account with another individual;
  • Transfer or sell your Account;
  • Use another person’s identity or information;
  • Create fraudulent or duplicate accounts.

Budastoor Motors reserves the right to suspend, restrict, or permanently terminate any Account suspected of misuse, fraud, or unlawful conduct.

5. LICENSE TO USE THE PLATFORM

Subject to compliance with these Terms, Budastoor Motors grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the TOUR Platform solely for lawful personal use.

No ownership rights are transferred to you under these Terms.

All rights not expressly granted remain the exclusive property of Budastoor Motors and its licensors.

6. INTELLECTUAL PROPERTY RIGHTS

All rights, title, and interest in and to the Platform, including but not limited to:

  • Trademarks
  • Logos
  • Software
  • Application designs
  • Databases
  • Graphics
  • Text
  • Content
  • Technology

Shall remain the exclusive property of Budastoor Motors W.L.L. and/or its licensors.

You may not:

  • Copy, reproduce, distribute, or commercially exploit the Platform;
  • Reverse engineer or decompile the software;
  • Modify or create derivative works;
  • Use TOUR branding without prior written authorization.

Unauthorized use may result in civil and criminal liability.

7. USER CONDUCT

You agree to use the Platform lawfully, responsibly, and respectfully.

You shall not:

  • Use the Platform for illegal or unauthorized activities;
  • Harass, threaten, abuse, or intimidate Drivers or other users;
  • Carry prohibited, dangerous, or illegal materials;
  • Damage vehicles intentionally or negligently;
  • Smoke or vape inside vehicles where prohibited;
  • Engage in conduct that compromises road safety;
  • Provide false complaints or fraudulent claims.

Budastoor Motors reserves the right to suspend or terminate Accounts involved in misconduct.

8. PASSENGER RESPONSIBILITIES

During the use of the Services, you agree that:

  1. You will comply with all applicable laws and regulations of Kuwait;
  2. You will wear seat belts where required by law;
  3. You will not exceed the permitted passenger capacity of the vehicle;
  4. You are responsible for any damages, excessive cleaning, or repair costs caused by you or your companions;
  5. You are solely responsible for your personal belongings;
  6. Budastoor Motors shall not be liable for lost, forgotten, stolen, or damaged items;
  7. Drivers may refuse or terminate trips in the event of unsafe, abusive, illegal, or threatening behaviour.

9. PROHIBITED ITEMS & ACTIVITIES

Users are strictly prohibited from transporting or carrying:

  • Illegal narcotics or controlled substances;
  • Weapons or explosives;
  • Flammable or hazardous materials;
  • Alcohol or prohibited substances in violation of Kuwaiti law;
  • Stolen goods or contraband.

Any violation may result in immediate termination of Services, reporting to authorities, and legal action.

10. VEHICLE & DRIVER AVAILABILITY

Budastoor Motors will make reasonable efforts to ensure availability of Drivers and vehicles; however:

  • Availability is not guaranteed at all times;
  • Arrival estimates are approximate only;
  • Vehicle type may vary based on operational availability;
  • Delays may occur due to traffic, weather, or unforeseen circumstances.

In case of breakdown or operational disruption, alternative arrangements may be attempted but are not guaranteed.

11. FARES, PRICING & CHARGES

Fares and charges may vary based on:

  • Distance travelled;
  • Trip duration;
  • Vehicle category;
  • Demand and surge pricing;
  • Waiting time;
  • Advance bookings;
  • Airport or remote-area surcharges;
  • Government fees, tolls, or parking charges.

Applicable pricing shall generally be displayed before confirmation of the booking where feasible.

Additional charges may apply for:

  • Waiting time;
  • Trip cancellation;
  • Excessive vehicle cleaning;
  • Vehicle damage;
  • Additional stops or route deviations.

Budastoor Motors reserves the right to revise pricing structures at any time without prior notice.

12. PAYMENT TERMS

Payments may be processed using:

  • Cash;
  • KNET;
  • Credit/Debit Cards;
  • Digital Wallets;
  • Promotional credits or coupons.

By providing payment information, you authorize Budastoor Motors to process all applicable charges.

You agree that:

  • All payments are due immediately upon completion of the Service;
  • Charges are generally non-refundable unless otherwise determined by the Company;
  • Failure to complete payment may result in suspension or legal recovery action.

13. CANCELLATION POLICY

Users may cancel bookings subject to applicable cancellation charges.

Cancellation fees may apply if:

  • A Driver has already been dispatched;
  • Excessive waiting time has occurred;
  • Repeated cancellations are detected.

Budastoor Motors reserves the right to determine cancellation fees and waive such fees at its sole discretion.

14. REFUND POLICY

Refunds, where approved, shall generally be processed using the original payment method.

Refund processing timelines may vary depending on financial institutions and payment providers.

Refunds may be denied in cases involving:

  • Fraudulent activity;
  • Abuse of promotional offers;
  • Violation of these Terms;
  • Completed rides without valid dispute grounds.

Wallet balances, promotional credits, and coupons may be subject to expiry periods determined by Budastoor Motors.

15. PROMOTIONS & REFERRAL PROGRAMS

Budastoor Motors may offer promotions, referral programs, discounts, vouchers, or coupon campaigns from time to time.

Such promotions:

  • May be withdrawn or modified without notice;
  • Cannot be exchanged for cash unless required by law;
  • May contain additional terms and eligibility conditions.

The Company reserves the right to cancel promotions in cases of misuse or suspicious activity.

16. PRIVACY & DATA PROTECTION

Budastoor Motors may collect, process, store, and use personal data in accordance with applicable laws and its Privacy Policy.

Collected data may include:

  • Name;
  • Mobile number;
  • Email address;
  • Payment information;
  • Device information;
  • GPS/location data.

By using the Platform, you consent to the collection and use of such information for operational, security, customer support, and marketing purposes.

You further consent to receiving:

  • SMS notifications;
  • Push notifications;
  • Emails;
  • Calls;
  • Promotional communications.

17. THIRD-PARTY SERVICES

The Platform may integrate with third-party systems, services, payment gateways, or external websites.

Budastoor Motors shall not be responsible for:

  • Third-party system failures;
  • Payment processing interruptions;
  • External content or services;
  • Third-party policies or conduct.

Your use of third-party services is entirely at your own risk.

18. DISCLAIMER

The Platform and Services are provided on an “as is” and “as available” basis.

Budastoor Motors makes no guarantees regarding:

  • Continuous availability of the Platform;
  • Error-free operation;
  • Accuracy of estimated arrival times;
  • Availability of Drivers or vehicles.

To the fullest extent permitted by law, all implied warranties are excluded.

19. LIMITATION OF LIABILITY

To the maximum extent permitted under Kuwaiti law, Budastoor Motors shall not be liable for:

  • Indirect or consequential damages;
  • Loss of profits or opportunities;
  • Service interruptions or delays;
  • Loss or damage to personal belongings;
  • Accidents caused by third parties;
  • Driver conduct outside the Company’s reasonable control.

In all circumstances, Budastoor Motors’ total liability shall not exceed the amount paid by the User for the specific trip giving rise to the claim.

20. INDEMNIFICATION

You agree to indemnify and hold harmless Budastoor Motors W.L.L., its directors, employees, affiliates, agents, and partners against all claims, damages, liabilities, costs, and legal expenses arising from:

  • Your misuse of the Platform;
  • Violation of these Terms;
  • Violation of applicable laws;
  • Damage caused to vehicles or third parties;
  • Fraudulent or unlawful conduct.

21. SUSPENSION & TERMINATION

Budastoor Motors reserves the right to suspend, restrict, or terminate your access to the Platform immediately and without prior notice if:

  • You breach these Terms;
  • Fraudulent activity is suspected;
  • Payment obligations are not fulfilled;
  • Safety concerns arise.

Termination shall not affect any accrued legal rights or outstanding payment obligations.

22. FORCE MAJEURE

Budastoor Motors shall not be liable for delays or failures caused by circumstances beyond reasonable control, including but not limited to:

  • Natural disasters;
  • Government restrictions;
  • Internet or network failures;
  • Traffic disruptions;
  • Civil unrest;
  • Pandemics;
  • Labour disputes.

23. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of Kuwait.

Any dispute arising out of or relating to these Terms, the Platform, or the Services shall be subject to the exclusive jurisdiction of the competent courts of Kuwait.

24. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain fully valid and enforceable.

26. ACCEPTANCE OF TERMS

By creating an Account, accessing, or using the TOUR Platform or Services, you confirm that you have read, understood, and agreed to these Terms & Conditions in full.
