This Compliance Policy (“Policy”) outlines the legal, operational, ethical, safety, and regulatory standards governing the operation and use of the TOUR Platform operated by Budastoor Motors W.L.L. (“Budastoor Motors”, “TOUR”, “Company”, “we”, “our”, or “us”) within the State of Kuwait.

The purpose of this Policy is to ensure that all Platform activities, transportation services, users, drivers, employees, contractors, and partners comply with applicable laws, regulations, and industry standards of Kuwait.


1. PURPOSE OF THIS POLICY

This Policy is designed to:

  • Ensure lawful and ethical business operations;
  • Promote passenger and driver safety;
  • Prevent fraud, misconduct, and illegal activities;
  • Protect user privacy and data;
  • Ensure compliance with Kuwait transportation and commercial regulations;
  • Maintain operational transparency and accountability.

2. SCOPE OF APPLICATION

This Policy applies to:

  • TOUR Platform users and passengers;
  • Drivers and transportation partners;
  • Employees, contractors, and representatives of Budastoor Motors;
  • Third-party vendors and service providers associated with the Platform.

All parties using or associated with the TOUR Platform are expected to comply with this Policy at all times.


3. REGULATORY COMPLIANCE

Budastoor Motors is committed to operating in compliance with all applicable laws and regulations of the State of Kuwait, including but not limited to:

  • Commercial and business licensing regulations;
  • Transportation and traffic laws;
  • Consumer protection laws;
  • Data privacy and cybersecurity regulations;
  • Anti-fraud and anti-money laundering obligations where applicable;
  • Employment and labor regulations;
  • Electronic transaction and payment regulations.

The Company reserves the right to modify operational procedures and policies to comply with evolving legal and regulatory requirements.


4. DRIVER COMPLIANCE REQUIREMENTS

All drivers operating through the TOUR Platform must:

  • Hold valid driving licenses and permits required under Kuwaiti law;
  • Maintain valid vehicle registration and insurance;
  • Operate roadworthy and legally compliant vehicles;
  • Comply with all traffic laws and road safety regulations;
  • Conduct themselves professionally and respectfully;
  • Avoid reckless, distracted, or unsafe driving practices.

Drivers are strictly prohibited from:

  • Operating under the influence of drugs or alcohol;
  • Carrying illegal goods or prohibited substances;
  • Engaging in harassment, discrimination, or abusive behavior;
  • Manipulating fares or trip information;
  • Using unauthorized accounts or fraudulent documentation.

Budastoor Motors reserves the right to suspend or permanently terminate driver access for non-compliance.


5. USER COMPLIANCE REQUIREMENTS

Users of the TOUR Platform must:

  • Provide accurate and truthful account information;
  • Use the Platform only for lawful purposes;
  • Respect drivers, vehicles, and other users;
  • Comply with all applicable Kuwaiti laws and regulations.

Users are prohibited from:

  • Carrying illegal or prohibited items;
  • Using fraudulent payment methods;
  • Providing false complaints or claims;
  • Damaging vehicles intentionally or negligently;
  • Harassing or threatening drivers or staff.

Violations may result in:

  • Account suspension or termination;
  • Financial liability;
  • Reporting to law enforcement authorities.

6. ANTI-FRAUD & ANTI-ABUSE POLICY

Budastoor Motors maintains a zero-tolerance policy toward fraud, abuse, and dishonest activity.

Prohibited activities include:

  • Fake bookings or ride manipulation;
  • Account impersonation;
  • Payment fraud or chargeback abuse;
  • Misuse of promotional offers or referral programs;
  • Submission of false claims or complaints;
  • Unauthorized use of another user’s account or identity.

The Company may investigate suspicious activity and cooperate with financial institutions and law enforcement authorities where necessary.


7. DATA PRIVACY & CONFIDENTIALITY

Budastoor Motors is committed to protecting user and business information.

All personal information collected through the Platform shall be handled in accordance with:

  • Applicable Kuwaiti laws;
  • The TOUR Privacy Policy;
  • Internal confidentiality and security procedures.

Employees, contractors, and partners must maintain strict confidentiality regarding user, operational, and business data.

Unauthorized disclosure or misuse of confidential information is strictly prohibited.


8. CYBERSECURITY & PLATFORM SECURITY

Budastoor Motors implements reasonable technical and organizational measures to protect the Platform against:

  • Unauthorized access;
  • Cyberattacks;
  • Data breaches;
  • Fraudulent activities;
  • Malware or malicious interference.

Users and drivers are responsible for:

  • Protecting account credentials;
  • Using official Platform channels only;
  • Reporting suspicious activity immediately.

The Company reserves the right to suspend accounts involved in suspected security threats.


9. SAFETY & OPERATIONAL COMPLIANCE

Budastoor Motors prioritizes passenger and driver safety.

Operational compliance measures include:

  • Monitoring service quality and safety reports;
  • Encouraging seat belt usage;
  • Enforcing lawful passenger capacity limits;
  • Investigating safety complaints;
  • Promoting respectful conduct during trips.

Drivers and users must comply with all TOUR Safety Instructions and related operational policies.


10. PROHIBITED ACTIVITIES

The following activities are strictly prohibited on or through the TOUR Platform:

  • Transportation of illegal substances or contraband;
  • Human trafficking or unlawful transportation;
  • Use of violence, threats, or intimidation;
  • Money laundering or financial crimes;
  • Unauthorized commercial activity using the Platform;
  • Use of the Platform for unlawful or immoral purposes under Kuwaiti law.

Any prohibited activity may result in immediate termination and referral to authorities.


11. REPORTING VIOLATIONS

Users, drivers, employees, and partners are encouraged to report:

  • Fraudulent activity;
  • Safety concerns;
  • Legal violations;
  • Harassment or misconduct;
  • Data security incidents;
  • Operational non-compliance.

Reports may be submitted through official customer support or compliance communication channels.

Budastoor Motors may investigate reported incidents confidentially and take appropriate corrective action.


12. INVESTIGATIONS & ENFORCEMENT

Budastoor Motors reserves the right to:

  • Monitor Platform activity;
  • Investigate suspected violations;
  • Suspend or terminate accounts;
  • Restrict access to Services;
  • Cooperate with regulatory and law enforcement authorities.

Failure to comply with this Policy may result in:

  • Permanent account removal;
  • Financial penalties or liability;
  • Legal proceedings where applicable.

13. THIRD-PARTY COMPLIANCE

Third-party vendors, payment providers, contractors, and service partners working with TOUR are expected to maintain compliance with applicable laws and contractual obligations.

Budastoor Motors may suspend or discontinue relationships with third parties failing to meet compliance standards.


14. RECORD RETENTION

The Company may retain operational, financial, and user-related records as required for:

  • Legal compliance;
  • Financial reporting;
  • Fraud prevention;
  • Regulatory obligations;
  • Dispute resolution.

Retention periods shall be determined in accordance with applicable laws and operational requirements.


15. POLICY UPDATES

Budastoor Motors reserves the right to amend or update this Compliance Policy at any time.

Updated versions shall become effective immediately upon publication within the Platform or official communication channels.

Continued use of the Platform constitutes acceptance of updated policies.


16. GOVERNING LAW

This Compliance Policy shall be governed by and interpreted in accordance with the laws of the State of Kuwait.

Any disputes arising from or related to this Policy shall be subject to the exclusive jurisdiction of the competent courts of Kuwait.
